ICE arrests mom outside of child custody hearing, attorneys say it’s suspicious

(KSHB/NBC News) One Kansas couple’s bitter dispute over where their daughter should attend school took a surprising turn at a recent court hearing.

“Two men walked up to my client and said her last name and said you need to come with us,” recalls attorney Bridget Schell.

Schell and her client, Lola Basic, had just gotten out of a child custody hearing on February 7th at the Johnson County courthouse. 

Basic and her ex-husband are in a bitter dispute over where their 14-year-old daughter should go to school in Kansas or Missouri. 

Two ICE agents arrested Basic in the hallway. 

Basic came legally to the United States from Uzbekistan in 1998 and overstayed her visa. 

She married Rafael Aponte several years ago, who is a U.S. Citizen and military veteran. 

“We tried to get her status fixed. We spent thousands of dollars on lawyers and the answer was always, ‘There’s just nothing we can do.’ So we’ve tried,” he says.
