NBC 4 Awaits E-mails From Attorney General's Office

COLUMBUS, Ohio -- E-mails between attorney general employees could be the key to proving or disproving allegations of sexual harassment against one of Attorney General Marc Dann's top advisors.

Anthony Gutierrez is accused of sexually harassing two female employees, one of whim has requested a criminal investigation be started.

A second top aide in the attorney general's office, Communications Director Leo Jennings, is also on administrative leave.

The e-mails are between Dann and scheduler Jessica Utovich. Utovich was at the Dublin townhome shared by Dann, Gutierrez and Jennings on the same night that a female co-worker claims she was sexually harassed.

Attorneys from the Public Records division of the attorney general's office have been reading through thousands of e-mails. Did the two discuss the events of Sept. 10 inside the townhome?

The attorneys are looking for information they deem privileged and not for public release, including attorney-client privileged conversations that give sensitive case information pertaining to law enforcement or personal cell phone numbers that the lawyers believe should not be public.

Their decisions of what not to release may be scrutinized as well, as the question of what constitutes a public record is debated.

Ted Hard, a spokesman for the attorney general's office said they could decide to redact any information that does not pertain to the operations of the office.

So what will the lawyers do with information that may pertain to the allegations of sexual harassment? Does Dann have input on what is released to the public? Hart said he does not believe Dann has any input and the attorneys will try to err on the side of disclosure.

The e-mails are the first of what could be thousands more that Target 4 has requested between various employees inside the attorney general's office.
